Man accused of using 9/11 story in alleged documentary scheme invoving a bad check, police say

A New Jersey man is accused of defrauding a Warrington Township video producer by claiming he was a millionaire whose parents died during the Sept. 11 attacks and hiring the victim to film a documentary before paying with a check drawn on a closed account, according to police.

Nelson Elberto Garcia, 60, of Audubon, N.J., is charged with felony counts of theft of services and writing bad checks, according to court records.

Police said the case began on Sept. 12, 2024, when the Warrington resident reported that he had been contacted by a man identifying himself as a millionaire whose parents were killed on Sept. 11, 2001. The victim, who owns a video production company, told police the man asked him to produce a documentary. 

The victim agreed, and on Aug. 30, 2024, he and an assistant drove to Edison, N.J., where they met the suspect and filmed about three hours of footage.

According to police, Garcia paid the victim $2,500 by check and asked that it be post-dated to Sept. 4, 2024. The victim later learned from his bank that the account the check was written from had been closed. Multiple attempts to contact the suspect were unsuccessful, police said.

Investigators identified the suspect as Garcia, who was 58 years old at the time of the incident and living in Metuchen, N.J., police said.

A warrant was issued, and on Oct. 7, 2025, Garcia was arrested in Woodbridge, N.J., and taken to the Middlesex County Correctional Facility. The Bucks County Sheriff’s Department transported him to Warrington Township on Oct. 23, where he was processed and arraigned.

Garcia is free on $25,000 unsecured bail, and a preliminary hearing is scheduled for Monday morning before Magisterial District Judge Stacy Wertman.
