Toddlers in soiled diapers found in car with woman passed out drunk behind the wheel, police say

Authorities allege Bucks County woman was drunk behind the wheel with open vodka and children in unsecured car seats in a McDonald's parking lot

A Perkasie woman faces a preliminary hearing later this month in Bucks County on felony charges of endangering the welfare of children and misdemeanor DUI for allegedly passing out while intoxicated in her Subaru in a McDonald's parking lot with two toddlers in the backseat who had soiled, saturated diapers and stained clothing.

Viktoriya Romanivna Martinez, 27, of the 100 block of Griffith Court, was arraigned last month on the offenses and released on $50,000 unsecured bond, per court documents.

On March 16 at 6:03 p.m., Hilltown Township Police were dispatched to the McDonald’s parking lot at 1511 Bethlehem Pike for a possible DUI involving an unconscious woman and two juveniles in the backseat of a black 2018 Subaru Outback, police said.

Police arrived on scene and met with VMSC Emergency Medical Services personnel and Hilltown Fire Co. members, who told police Martinez was passed out behind the wheel and that they had to open the driver side door to turn off the engine, according to the criminal complaint.

Upon approaching the driver door, police smelled an odor of alcohol in the car, per the affidavit. Martinez was awakened and police noticed her eyes were slow to follow the direction of her head, her eyes were watery and glossy, and both pupils were dilated, police allege.

Next to Martinez was an open 750 mL Smirnoff orange-flavored vodka, police said.

Martinez allegedly failed multiple times to pass a preliminary breath test and an odor of alcohol was on her breath. Her speech was slurred and she spoke in a lethargic manner, police said.

Multiple open White Claws were found inside a McDonald’s bag on the front passenger floor, police said.

Police said two toddlers, ranging in age from one to two years old, were in the backseat, with diapers that saturated their pants.

Upon removal of the children from the car by paramedics, police found the car seats were not secured or fastened to the seat in any manner, according to the affidavit.

Martinez was taken into custody and agreed to a legal blood draw to determine BAC, police said, however she refused a blood test at the hospital.

She was taken to Perkasie Police for processing and later released to her mother, police said.

Martinez is free on $50,000 unsecured bond, with a preliminary hearing set for May 27 at 2:15 p.m. before Magisterial District Judge Regina Armitage. She is represented by defense attorney Kevin Parlow of Bensalem.
