Man charged with felony drug offenses for allegedly possessing meth, marijuana in traffic stop

A Bucks County man faces felony drug charges after being caught by police allegedly smoking marijuana and possessing a quarter-ounce of methamphetamine in July in a Warrington Township hotel parking lot in the daytime.

Andrew Clarance Miller, 38, of the 1400 block of Brook Lane, Jamison, and homeless man Kyle Kostick, 38, was charged Aug. 27 with felony criminal use of a phone and felony possession of a controlled substance, per court records, along with misdemeanor possession of a controlled substance and possession of drug paraphernalia. Police also charged Miller with windshield obstruction for allegedly using a windshield sunscreen during the alleged crime and having very tinted windows, per court records.

Miller is free on $20,000 unsecured bail, set by Magisterial District Judge Stacy Wertman at arraignment. A preliminary hearing is set before Wertman for Oct. 28 at 9 a.m.

On July 15, at 11:15 a.m., police were in an unmarked patrol car in the Sunoco lot, 580 Easton Road, Warrington Township, when a man was seen rolling a marijuana cigar, or blunt, in the parking lot, police said.

Shortly after, a gray 2015 Audi CP coupe exits the parking lot, with the man observed earlier in the passenger seat, police said.

Police followed the Audi, allegedly driven by Miller, as it drove to and parked in the lot of the Hampton Inn, 201 Metro Drive, Warrington Township, according to the affidavit. Police said both front windows were tinted, which made it difficult to see inside the car. Furthermore, a sun visor was put up on the front windshield, which also blocked the interior of the car, police said.

After a few minutes, the Audi exited the lot and drove north on Easton Road, police said, and changed lanes near 385 Easton Road without signaling. Thus, police initiated a traffic stop after the car crossed the intersection of Street Road, police said, in front of Valley Square Shopping Center on Easton Road.

While speaking with Miller, police noticed an odor of fresh marijuana  emanating from the car, per the complaint. Miller was asked to exit the car, and police said he gave inaccurate and incomplete answers regarding general itinerary questions.

The passenger removed his bookbag from the car and placed it on the ground beside the vehicle, police said.

Police searched the car and found an orange zippered bag on the rear seats behind the front passenger, per the complaint. Inside the bag was $20 cash, one glass smoking device with brown and black burnt residue, one small empty plastic container, a large plastic container with a white crystal substance, one butane lighter, and a black digital scale with white crystal residue, police said.

Police said chemical testing revealed the white substance to be 7.76 grams of methamphetamine. The scale and glass device also contained methamphetamine residue, police said.

Police took the passenger into custody, and during a search of his bag, police found narcotics and paraphernalia in the top zippered part of the bag, per the complaint.

Police also found a small plastic jar similar to the one found in the orange bag, with a small amount of white crystal substance, police said. The substance came back confirmed to be .91 grams of methamphetamine, police said.

In the search of the passenger’s bag, a designer baggie was found with a small amount of green leafy substance later confirmed to be marijuana, police said.

On Aug. 12, police issued a search warrant on Miller’s cell phone, which was collected as evidence at the arrest, per the affidavit.

While reviewing the phone, police found communication on multiple messaging platforms regarding re-supply and distribution of narcotics, police said. On conversation, police allege, was on July 15, at 9:54 a.m., where Miller texted the co-defendant to meet at the Sunoco and then travel to Hampton Inn.

At 11:36 p.m., Miller sent the passenger a text that said, “He’s gonna find my s---,” “There’s no way he doesn’t” and “I’m so f----ed rn,” police said. Thus, it was determined Miller was texting the passenger while police were searching the car, police said.

The passenger, a 38-year-old homeless man, was charged with three misdemeanor drug charges, and was originally arraigned on 10% of $40,000 cash bail, but was changed to nonmonetary by Bucks County Common Pleas Court, per court records.
