A Perkasie Borough man was arraigned last week on a charge of felony DUI after he was allegedly found passed out at 2 a.m. over the summer, with his foot on the brake of a car, which did not have the DUI-related ignition interlock as required by law.
William Michael Carr, 35, of the 500 block of S 12th Street, Perkasie Borough, was arrested and charged in June by borough police with the felony, as well as misdemeanor illegal operation of a car without an ignition interlock and summary driving with a BAC of .02% or greater while a license is suspended, per charging documents.
Carr remains jailed in Bucks County on 10% of $10,000 cash bail, set by Magisterial District Judge Regina Armitage at arraignment, per a criminal docket.
At 2:20 a.m. June 9, police found a black Pontiac idling in the parking lot of the closed US Gas at 401 E. Walnut St., in Perkasie, Bucks County, with its headlights on and brake lights illuminated, per the affidavit.
Police approached the car, and allegedly found Carr passed out and leaning sideways on the center console. He was roused from sleep and police saw he was sweating profusely, despite overnight cold temperatures, police said. He also allegedly had dilated, bloodshot eyes and slurred his words to the point of unintelligibility, per the complaint.
Carr, police said, told them he was in the middle of moving from his apartment in Philadelphia back to his mother’s residence, and was making trips with personal items. He told police he stopped briefly to check the GPS on his phone and fell asleep, per the complaint.
Police said they were familiar with Carr from prior interactions. Carr, police said, claimed he was clean and sober for nearly one year.
When police ran Carr’s information through their database, it revealed a DUI-related driver’s license suspension for one year, as of Feb. 7, per the affidavit. The license noted Carr required use of an ignition interlock, which was not equipped on the car, police said.
Carr agreed to, and failed, field sobriety tests, police said, even telling them a prior fracture of his left foot in several places has affected his mobility. He also refused a blood test for BAC after he was taken into custody at 2:47 a.m., police said.
Carr has a preliminary hearing on Dec. 3 at 1:30 p.m. before Armitage.
